IRS/identity theft part 3

Our lawyer informed us that we could file a tax amendment to try to file "married filing separately" so we looked into that only to realize we'd get less than 1/2 of our original return back.
At first we decided that we would NOT take that route, but then the Harley payment messed up and things came up.... so here we are now awaiting the reply to the amendment we submitted. We put it in last week and it takes 6-8 weeks to process. I'm so upset by this but overall we really need to pay off the first bike payment loan and doing this will allow (if it goes through) us to do that much and be better off (by a tiny bit) monthly, so overall we both feel it's the right choice. A very crappy choice, but the right choice.


As far as the identity theft battle goes, the loan paperwork (that was signed electronically for the student loan) has a parent's name (Not mine) and a reference (that I've never heard of) so that's a start.
I've sent in papers saying it's okay for my lawyer to speak on my behalf (which hopefully accomplishes a lot and I assume it will since at our last meeting he called the university and got more information in 5 minutes than I did in 3 phone calls).

Overall, I'm exhausted, it's a headache, David and I are both stressed out and snapping at each other almost daily because we're so stressed out about this mess, another reason we both agreed that filing the amendment was probably the best choice.

Please just think happy thoughts for us.
At this rate, I don't know how many more hits we can take and I just truly hope things begin to look up soon.

Some things aside, there are no problems like IRS ones. I'm in the IRS boat too so I can imagine your stress and frustration. My thoughts are seriously with you guys. When you guys make it through this, you'll be able to take on anything.

Did anyone tell you to file an injured spouse return? Might want to check it out on irs.gov - I hope things get better soon.

OH MY GOSH. I just saw these posts and I am SO ANGRY for you, Amber. I hate dishonest people and it sucks that they chose you, someone who has worked hard with her husband, to prey on. I'll be thinking of y'all and hoping that things turn out in the end!

Wow. I totally missed your two other posts about this. And I'm so sad to hear you're going through this. It sounds like a nightmare. I wonder if this woman is still attending classes at the school, and what the school will do now that this investigation is starting up. And she's even taken out car loans and utilities and done medical treatments under your name? OMFG I'd be so livid. I really hope you can get this worked out soon.Hopefully they just zero all of this out, and you'll be in the clear. But I also wonder if you'd be able to sue her for, I don't know, damages or hardship or something. I'm spiteful so that's what I'd try doing anyway. Grr to that woman for stealing your identity!
